1. Acceptance of Terms

By accessing or using ClaritiForms ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. ClaritiForms provides self-help legal document templates and related information for personal and business use in Jamaica and the wider Caribbean region.

2. No Legal Advice or Attorney-Client Relationship

ClaritiForms is not a law firm and does not engage in the practice of law. The documents, templates, guides, and information provided through the Service are for self-help, informational, and educational purposes only. They do not constitute legal advice, legal opinion, or a recommendation regarding any course of action.

No attorney-client relationship is created between you and ClaritiForms, its owners, employees, or affiliates by your use of the Service. The information on this site is not a substitute for the advice of a licensed attorney who is qualified to practice law in your jurisdiction.

You should consult a licensed attorney in the relevant jurisdiction before using any document or taking any legal action. You acknowledge that your use of any template or information is entirely at your own risk.

3. Self-Help Use Only

The templates and documents on ClaritiForms are provided as starting points. They are generic in nature and may not reflect the most current legal developments, address your specific facts or circumstances, or comply with the laws of your jurisdiction. You are solely responsible for ensuring that any document you create or use is appropriate for your situation and is legally valid in your jurisdiction.

4. Electronic Signature Consent

By using ClaritiForms, you consent to the use of electronic signatures, records, and disclosures in connection with the documents you create. You agree that your electronic signature is the legal equivalent of your manual/handwritten signature for all purposes under applicable law, including the Electronic Transactions Act of Jamaica and similar laws in other jurisdictions. Exception: Electronic signatures are not valid for wills or testamentary documents. Wills must be physically signed in the presence of two witnesses in accordance with the Wills Act of Jamaica.

5. Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction;
• You are of sound mind and legally capable of entering into binding contracts;
• You are not located in a country subject to a sanctions embargo or designated as high-risk by the Caribbean Financial Action Task Force (CFATF);
• You have not previously been suspended or removed from the Service.

6. Account Terms

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete registration information;
• Maintain and promptly update your account information;
• Keep your password secure and confidential;
• Notify us immediately of any unauthorized use of your account at support@claritiforms.com;
• Be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

7. Payment and Refunds

Certain features of the Service may require payment. By purchasing a subscription or document, you agree to pay the applicable fees as described at the time of purchase. All payments are processed securely through Stripe. We do not store full credit card numbers on our servers.

30-Day Refund Policy: If you are not satisfied with your purchase, you may request a full refund within 30 days of the original purchase date. To request a refund, contact support@claritiforms.com. After 30 days, all sales are final. Refunds are processed to the original payment method within 5–10 business days.

We reserve the right to change our pricing at any time. Any price changes will apply to future billing cycles only.

8. Prohibited Uses

You agree not to use the Service to:

• Engage in any illegal activity or violate any applicable law or regulation;
• Create documents for fraudulent, deceptive, or misleading purposes;
• Misrepresent your identity, qualifications, or relationship with ClaritiForms;
• Use the Service in a way that infringes the intellectual property rights of others;
• Attempt to reverse-engineer, hack, disrupt, or compromise the integrity of the Service;
• Upload or transmit viruses, malware, or any malicious code;
• Use the Service to send unsolicited communications (spam);
• Access or attempt to access another user's account without authorization.

9. Intellectual Property

All content on the Service — including templates, text, graphics, logos, and software — is the property of ClaritiForms or its licensors and is protected by copyright and intellectual property laws. You may use the templates for your personal or business purposes, but you may not reproduce, distribute, modify, or create derivative works of the templates for commercial resale without our written consent.

10. Limitation of Liability — EXPRESS ASSUMPTION OF RISK

YOU EXPRESSLY ASSUME ALL RISKS AND RESPONSIBILITIES associated with the use of the Service and any documents, templates, or information obtained through it.

To the maximum extent permitted by law, ClaritiForms, its owners, directors, employees, contractors, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages for:

• Legal outcomes or consequences of using any document or template;
• Reliance on any information obtained from the Service;
• Errors, omissions, or inaccuracies in templates or content;
• Loss of data, revenue, or business opportunities;
• Unauthorized access to or alteration of your transmissions or data.

INDEMNIFICATION: You agree to indemnify, defend, and hold harmless ClaritiForms, its owners, directors, employees, contractors, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service or any document obtained through it; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any legal challenge to the validity, enforceability, or adequacy of any document created using the Service.

Your sole remedy for dissatisfaction with the Service is to discontinue use. In no event shall our total liability to you exceed the amount paid by you (if any) in the 12 months preceding the claim, or USD $100.00, whichever is less.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• The templates or documents will meet your specific legal needs;
• The templates or documents will be legally valid or enforceable in your jurisdiction;
• Any errors or defects will be corrected.

12. Class Action Waiver and Dispute Resolution

CLASS ACTION WAIVER: To the fullest extent permitted by law, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, private attorney general action, or consolidated action against ClaritiForms.

DISPUTE RESOLUTION: Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiations. If the dispute cannot be resolved within 30 days, the parties agree to submit the dispute to binding mediation in Kingston, Jamaica, before resorting to litigation. The prevailing party in any mediation or litigation shall be entitled to recover its reasonable legal costs and fees.

13. DMCA / Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content on the Service infringes your copyright, please send a notice to support@claritiforms.com with the following information:

• Identification of the copyrighted work claimed to be infringed;
• Identification of the allegedly infringing material and its location on the Service;
• Your contact information (name, address, email, and phone number);
• A statement that you have a good faith belief that the use is not authorized by the copyright owner;
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner;
• Your physical or electronic signature.

We will respond to all valid DMCA takedown notices and may terminate the accounts of repeat infringers.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Kingston, Jamaica. You consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.
